This Privacy Policy ("Policy") explains how Traqer LLC, doing business as Traqer.ai ("Traqer," "we," "our," or "us"), collects, uses, discloses, retains, and protects information when you access or use our website located at https://www.traqer.ai, the Traqer application, and all related services, features, and content (collectively, the "Service").

This Policy applies to all users of the Service, including visitors, free trial users, and paid subscribers. It also describes your rights regarding your personal information and how you can exercise those rights.

By accessing or using the Service, you acknowledge that you have read, understood, and agree to the collection, use, and disclosure of your information as described in this Policy. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to this Policy.

1. Information We Collect

We collect information in several ways as described below. The categories of information we collect depend on how you interact with the Service.

A. Information You Provide Directly

When you create an account, subscribe to a plan, or otherwise interact with the Service, you may provide us with the following information:

  • Account Information: Your name, email address, company name, job title, and account credentials (username and password).
  • Billing Information: Payment card details, billing address, and related financial information. Payment information is processed directly by our third-party payment processor (currently Stripe, Inc.). Traqer does not store, process, or have access to full credit card numbers, CVVs, or complete payment card data on our servers.
  • Communications: Information you provide when you contact us for support, submit feedback, respond to surveys, or otherwise communicate with us.
  • Platform Inputs: Brand names, competitor names, search queries, keywords, URLs, and other data you submit into the Service for tracking and analysis purposes.
B. Information Collected Automatically

When you access or use the Service, we automatically collect certain technical and usage information, including:

  • Device Information: IP address, browser type and version, operating system, device type, device identifiers, screen resolution, and language preferences.
  • Usage Data: Pages and features accessed, actions taken within the Service, login and logout timestamps, session duration, clickstream data, and feature interaction patterns.
  • Log Data: Server logs that record requests made to our servers, including referring and exit URLs, HTTP method, date and time stamps, and error information.
  • Location Data: Approximate geographic location inferred from your IP address. We do not collect precise geolocation data.

This information is collected to maintain security, diagnose technical issues, analyze usage trends, and improve the Service.

C. Publicly Available Information

The Service accesses and analyzes information from publicly available web pages and AI-generated search results to produce analytics and insights for our users. With respect to this information:

  • We access only content that is publicly available without authentication or login credentials;
  • We do not bypass, circumvent, or override any access controls, robots.txt directives, or technical barriers;
  • We do not republish, redistribute, or display full third-party content to users;
  • We process publicly available information to generate analytical outputs, summaries, and comparative insights;
  • We do not claim ownership of any third-party content accessed through this process.
D. Cookies and Tracking Technologies

We use cookies, web beacons, pixels, and similar tracking technologies to operate and improve the Service. Specifically, we use:

  • Strictly Necessary Cookies: Required for authentication, session management, and core Service functionality. These cannot be disabled without impairing the Service.
  • Functional Cookies: Used to remember your preferences, settings, and customizations.
  • Analytics Cookies: Used to understand how users interact with the Service, measure performance, and identify areas for improvement. We may use third-party analytics services such as Google Analytics.

You can manage your cookie preferences through your browser settings. Most browsers allow you to block or delete cookies. However, disabling certain cookies may impair or limit Service functionality. For more information about cookies, visit www.allaboutcookies.org.

Do Not Track Signals: Some browsers transmit "Do Not Track" (DNT) signals. There is currently no universally accepted standard for how companies should respond to DNT signals. At this time, the Service does not respond to DNT signals, but we will update this Policy if our practices change. California users should refer to Section 9 for information about "Global Privacy Control" signals.

2. AI Processing & Third-Party Model Providers

Certain features of the Service rely on third-party artificial intelligence and machine learning providers to generate analytics, insights, and other outputs. Our current AI providers include, but are not limited to:

  • OpenAI (GPT models)
  • Google AI Mode
  • Perplexity
  • Gemini

When you use AI-powered features of the Service:

  • Inputs you submit (such as brand names, keywords, and queries) may be transmitted to these providers via their commercial API services for processing;
  • Outputs (such as visibility reports, rankings, and summaries) are generated algorithmically by these providers and returned to Traqer for display within the Service;
  • We use commercially available API services subject to data processing agreements with these providers;
  • We use reasonable efforts to ensure that our AI providers do not use your inputs to train their general-purpose models, though we cannot guarantee the internal practices of third-party providers.

Traqer does not use customer-submitted data to independently train, fine-tune, or develop its own proprietary machine learning models.

The data processing and privacy practices of our AI providers are governed by their respective terms of service and privacy policies. We encourage you to review those policies. We will update this section if we add or change AI providers in a material way.

3. How We Use Information

We use the information we collect for the following purposes:

  • Service Delivery: To provide, operate, maintain, and improve the Service, including generating analytics, reports, and insights.
  • Account Management: To create and manage your account, authenticate your identity, and process subscription changes.
  • Payment Processing: To process payments, manage billing, issue invoices, and handle refund requests through our third-party payment processors.
  • Communications: To send you transactional communications (such as account confirmations, billing notices, and security alerts), respond to your inquiries, and provide customer support.
  • Product Improvement: To analyze usage patterns, diagnose technical issues, conduct internal research, and develop new features and functionality.
  • Security & Fraud Prevention: To detect, investigate, and prevent fraudulent, unauthorized, or illegal activity, and to protect the security and integrity of the Service.
  • Legal Compliance: To comply with applicable laws, regulations, legal processes, and enforceable governmental requests.
  • Aggregated Analytics: To create aggregated, de-identified, and anonymized datasets for benchmarking, industry insights, and product improvement purposes, provided that such data cannot reasonably be used to identify you or your business.

Marketing Communications: We may send you marketing or promotional communications about the Service. You may opt out of marketing communications at any time by clicking the "unsubscribe" link in any marketing email or by contacting us at support@traqer.ai. Opting out of marketing communications does not affect transactional or service-related communications.

4. Legal Bases for Processing

If you are located in the European Economic Area (EEA), United Kingdom (UK), or another jurisdiction that requires a legal basis for processing personal data, we rely on the following legal bases:

  • Performance of a Contract: Processing necessary to provide the Service to you under our Terms of Use (e.g., account creation, payment processing, service delivery).
  • Legitimate Interests: Processing necessary for our legitimate business interests, including product improvement, fraud prevention, security, analytics, and direct marketing, where those interests are not overridden by your fundamental rights and freedoms.
  • Legal Obligation: Processing necessary to comply with applicable laws, regulations, or legal processes.
  • Consent: Where required by applicable law, we process personal data based on your freely given, specific, informed, and unambiguous consent. You may withdraw consent at any time, though withdrawal does not affect the lawfulness of processing conducted prior to withdrawal.
5. How We Share Information

We do not sell, rent, or lease your personal information to third parties. We do not share your personal information for third-party advertising or cross-context behavioral advertising purposes.

We may disclose your information in the following circumstances:

A. Service Providers

We engage trusted third-party companies and individuals to perform functions on our behalf, including:

  • Payment processing (e.g., Stripe)
  • Cloud hosting and infrastructure (e.g., AWS, Google Cloud, or similar)
  • Analytics (e.g., Google Analytics)
  • Customer support tools (e.g., Intercom, Zendesk, or similar)
  • AI and machine learning API providers (e.g., OpenAI, Perplexity, Gemini)
  • Email and communications platforms

These service providers are contractually obligated to use your information only for the purposes of performing services on our behalf and are required to maintain appropriate security measures. We enter into data processing agreements with service providers where required by applicable law.

B. Legal Requirements

We may disclose your information if we believe in good faith that disclosure is necessary to: (a) comply with applicable law, regulation, legal process, or enforceable governmental request; (b) enforce our Terms of Use or other agreements; (c) detect, prevent, or address fraud, security, or technical issues; or (d) protect the rights, property, or safety of Traqer, our users, or the public as required or permitted by law.

C. Business Transfers

If Traqer is involved in a merger, acquisition, reorganization, bankruptcy, dissolution, sale of all or a portion of its assets, or other corporate transaction, your information may be transferred, sold, or disclosed as part of that transaction. We will provide notice before your personal information is transferred and becomes subject to a different privacy policy, to the extent required by applicable law.

D. With Your Consent

We may share your information with third parties when you have given us explicit consent to do so.

E. Aggregated or De-Identified Data

We may share aggregated, de-identified, or anonymized information that cannot reasonably be used to identify you with third parties for research, benchmarking, marketing, or other purposes. Such information is not considered personal information under this Policy.

6. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this Policy, including:

  • Active Account: We retain your information for as long as your account remains active and as needed to provide the Service.
  • Post-Termination: Following account termination or cancellation, we will retain your information for a period of up to thirty (30) days to allow for account reactivation or data export requests. After this period, we will delete or anonymize your personal information, unless a longer retention period is required.
  • Legal Obligations: We may retain certain information for longer periods as required by applicable tax, accounting, regulatory, or legal obligations.
  • Dispute Resolution: We may retain information as necessary to resolve disputes, enforce our agreements, and establish or defend legal claims.

Publicly available third-party content accessed by the Service for analytics purposes is processed transiently and is not stored in full-page form for long-term republication or redistribution.

When personal information is no longer needed, we will securely delete or irreversibly anonymize it in accordance with our internal data retention policies and applicable law.

7. Data Security

We implement and maintain reasonable and appropriate administrative, technical, and organizational security measures designed to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include, but are not limited to:

  • Encryption of data in transit (TLS/SSL) and at rest where commercially reasonable;
  • Access controls and authentication requirements for employees and contractors;
  • Regular security assessments and monitoring;
  • Incident response procedures for suspected data breaches.

Despite our efforts, no method of electronic transmission or storage is completely secure. We cannot and do not guarantee absolute security of your information. You acknowledge and accept the inherent risk of providing information over the internet and agree that we shall not be liable for any breach of security beyond our reasonable control.

If we become aware of a security breach that affects your personal information, we will notify you and any applicable regulatory authorities in accordance with applicable law, including the California Civil Code § 1798.82 and related notification requirements.

8. Your Rights

Depending on your location and applicable law, you may have certain rights regarding your personal information. These rights may include:

  • Right to Correction: The right to request correction of inaccurate or incomplete personal information.

We will respond to verified requests within the timeframes required by applicable law (generally within 45 days for California residents, or 30 days for EEA/UK residents). We may need to verify your identity before processing your request. We will not discriminate against you for exercising your privacy rights.

9. California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, "CCPA"), provides you with specific rights regarding your personal information. This section supplements the rest of this Policy with information required by the CCPA.

A. Categories of Personal Information Collected

In the preceding twelve (12) months, we have collected the following categories of personal information as defined by the CCPA:

  • Identifiers: Name, email address, IP address, account name.
  • Commercial Information: Subscription records, billing history, purchase history.
  • Internet or Electronic Network Activity: Browsing history within the Service, search history, interaction data, log data.
  • Professional or Employment-Related Information: Company name, job title.
  • Inferences: Inferences drawn from the above to create a profile reflecting preferences and usage patterns.
B. Purposes for Collection

We collect personal information for the business and commercial purposes described in Section 3 of this Policy.

C. Categories of Sources

We collect personal information from: (a) you directly; (b) automatically through your use of the Service; and (c) publicly available sources.

D. Sharing and Disclosure

We disclose personal information to the categories of service providers described in Section 5 of this Policy for the business purposes described herein.

E. Sale and Sharing

Traqer does not "sell" personal information as defined by the CCPA. Traqer does not "share" personal information for cross-context behavioral advertising as defined by the CCPA.

F. Your California Rights

As a California resident, you have the right to:

  • Right to Know: Request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purposes for collection, and the categories of third parties to whom we have disclosed your personal information.
  • Right to Delete: Request deletion of personal information we have collected from you, subject to certain legal exceptions.
  • Right to Correct: Request correction of inaccurate personal information.
  • Right to Opt Out of Sale/Sharing: Although we do not sell or share personal information, you may submit an opt-out request at any time.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.
G. How to Submit a Request

To submit a verifiable consumer request, contact us at: support@traqer.ai. You may also designate an authorized agent to submit a request on your behalf. We may require the authorized agent to provide written proof of authorization and may need to verify your identity directly.

We will acknowledge receipt of your request within ten (10) business days and will respond to verified requests within forty-five (45) calendar days. If we require additional time (up to an additional 45 days), we will notify you of the reason and extension period in writing.

H. Global Privacy Control

We recognize and honor "Global Privacy Control" (GPC) signals as a valid opt-out request under the CCPA. If your browser or device transmits a GPC signal, we will treat it as a request to opt out of the sale or sharing of personal information associated with that browser or device.

I. Financial Incentive Programs

We do not offer financial incentive programs that require disclosure under the CCPA at this time.

J. CCPA Metrics

As required by the CCPA, we will compile and disclose annual metrics regarding consumer requests received, complied with, and denied, to the extent applicable based on our business volume.

10. Additional State Privacy Rights

Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Oregon (OCPA), Montana (MCDPA), and other states with comprehensive consumer privacy laws may have additional rights, including the right to access, correct, delete, and obtain a copy of personal data, as well as the right to opt out of targeted advertising, the sale of personal data, and profiling in furtherance of decisions that produce legal or similarly significant effects. 11. International Data Transfers

Traqer is based in the United States. If you access the Service from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries where our service providers maintain facilities.

These countries may have data protection laws that are different from, and potentially less protective than, the laws of your jurisdiction. By using the Service, you acknowledge and consent to the transfer of your information to the United States and other jurisdictions as described in this Policy.

For transfers of personal data from the EEA, UK, or Switzerland, we rely on appropriate transfer mechanisms recognized under applicable data protection law, including Standard Contractual Clauses (SCCs) approved by the European Commission, or other lawful transfer mechanisms.

12. Children's Privacy

The Service is designed for business use and is not directed to individuals under the age of eighteen (18). We do not knowingly collect, solicit, or maintain personal information from anyone under the age of 18. If we learn that we have collected personal information from a child under 18, we will promptly delete that information. If you believe we have collected information from a child under 18, please contact us immediately at support@traqer.ai.

13. Third-Party Links and Services

The Service may contain links to third-party websites, applications, or services that are not owned or controlled by Traqer. This Policy does not apply to third-party services, and we are not responsible for the privacy practices, content, or security of any third-party websites or services. We encourage you to review the privacy policies of any third-party services you access.

14. Data Processing Agreement

If you require a Data Processing Agreement (DPA) or Data Processing Addendum in connection with your use of the Service (for example, to comply with GDPR or other applicable data protection laws), please contact us at support@traqer.ai. We will work with you in good faith to execute appropriate data processing terms.

15. Sensitive Personal Information

Traqer does not intentionally collect or process "sensitive personal information" as defined under the CCPA (Cal. Civ. Code § 1798.140(ae)), the GDPR (Article 9), or similar definitions under other applicable privacy laws. This includes, but is not limited to: Social Security numbers, financial account credentials, precise geolocation data, racial or ethnic origin, religious beliefs, genetic or biometric data, health information, sexual orientation, or citizenship/immigration status. Please do not submit sensitive personal information through the Service.

16. Automated Decision-Making

The Service uses automated processes to generate analytics, insights, and reports. These automated processes analyze publicly available data and your platform inputs to produce AI visibility metrics and competitive intelligence. We do not use automated decision-making to make decisions that produce legal or similarly significant effects on you. 17. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will: (a) update the "Last Updated" date at the top of this Policy; and (b) provide reasonable notice, such as via email to the address associated with your account or through a prominent in-app notification.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Policy. If you do not agree with the updated Policy, you must stop using the Service and cancel your account. We encourage you to review this Policy periodically.

For material changes that significantly expand our use of your personal information or that reduce your privacy rights, we will provide at least thirty (30) days' advance notice before the changes take effect.
